BY ACCESSING, BROWSING, OR OTHERWISE USING ANY WEBSITE, MOBILE APPLICATION, OR OTHER SERVICE PROVIDED BY PASTUREPOST (COLLECTIVELY, THE “SERVICES”), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS, INCLUDING OUR PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO EVERY PROVISION OF THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.

Terms and Conditions of Use

Welcome to PasturePost (“PasturePost,” “we,” “us,” or “our”). PasturePost is an online equine classifieds marketplace dedicated to connecting the global horse community—buyers, sellers, breeders, trainers, and service providers—through a safe, transparent, and easy‑to‑use platform. These Terms and Conditions (“Terms”) govern your access to and use of the PasturePost website, mobile applications, and any related tools, features, or services we operate (collectively, the “Services”).
You must be at least eighteen (18) years old, or the age of majority in the jurisdiction from which you access the Services—whichever is greater (the “Minimum Age”)—to register for, access, or otherwise use the Services. Individuals who do not meet the Minimum Age may use the Services only under the direct supervision of, and with the express, verifiable consent of, a parent or legal guardian who: (a) maintains an active account in good standing; (b) agrees to be fully responsible for the minor’s access to and use of the Services; and (c) accepts these Terms on the minor’s behalf.
By accessing or using any portion of the Services, you represent, warrant, and covenant that: (a) you have the full legal right, power, and authority to enter into and perform under these Terms; (b) your execution of and performance under these Terms does not and will not conflict with or violate any other agreement to which you are a party or by which you are bound; (c) you are not barred from receiving the Services under the laws of the United States or any other applicable jurisdiction, including export‑control or sanctions regulations; and (d) you will at all times comply with all applicable local, state, national, and international laws, rules, and regulations in connection with your access to and use of the Services. If you access or use the Services on behalf of a company, organization, or other legal entity (an “Entity”), you: (i) represent and warrant that you are duly authorized to bind that Entity to these Terms; (ii) acknowledge that the terms “you” and “your,” as used in these Terms, refer to both you and the Entity collectively; and (iii) agree that the Entity will be jointly and severally liable for any breach of these Terms by you or any other person who accesses the Services through your account. PasturePost reserves the right, in its sole discretion, to verify any user’s authority and compliance, and to suspend or terminate any account or access if we believe, in good faith, that a user has breached the foregoing representations, warranties, or covenants.

By creating an account, posting a listing, purchasing a membership, or otherwise accessing or using any portion of the Services, you agree—on behalf of yourself and any person or entity who accesses the Services through your account—to comply with and be legally bound by (i) these Terms, (ii) our Privacy Policy, and (iii) any additional terms and conditions referenced herein or applicable to specific features, products, or promotions (collectively, “Additional Terms”). If there is a direct conflict between these Terms and any Additional Terms, the Additional Terms will govern solely with respect to the subject matter to which they apply.

PRIVACY

Your use of the Services is also governed by our Privacy Notice, which explains how we collect, use, disclose, and safeguard your personal information. By accessing or using the Services, you acknowledge that you have read the Privacy Notice and consent to all actions we take with respect to your information consistent with that Notice

COPYRIGHT

All content made available through the Services other than User Content—including, without limitation, text, graphics, logos, icons, photographs, audio clips, video, software, and trademarks (collectively, “PasturePost Content”)—is owned by PasturePost or its licensors and is protected by United States and international copyright, trademark, patent, trade‑secret, and other intellectual‑property laws.

ELECTRONIC COMMUNICATIONS

When you access or use the Services—or when you send emails, text messages, direct messages, or other communications to us from any device—you are engaging in “Electronic Communications.” You expressly consent to receive Electronic Communications from PasturePost, including, without limitation, service announcements, account notices, transactional receipts, security alerts, and surveys. You agree that all agreements, notices, disclosures, authorizations, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing and delivered in a form you can retain. You are responsible for keeping your email address, mobile number, and any other contact information associated with your account current so that we can communicate with you. PasturePost is not responsible for any automatic filtering that you or your network provider may apply to Electronic Communications.

YOUR ACCOUNT

To access certain features of the Services, you must register and maintain an account (an “Account”). You agree to provide and maintain accurate, current, and complete information throughout the registration process and thereafter. You may not create an Account using a false identity, another person’s information, or an email address that you do not own or have the right to use. You are solely responsible for safeguarding the confidentiality of your Account credentials and for all activities, charges, and liabilities that occur under your Account, whether or not authorized by you. You agree to: (a) immediately notify PasturePost of any actual or suspected unauthorized access to or use of your Account or any other breach of security; (b) use commercially reasonable efforts to prevent unauthorized access to or use of the Services; (c) log out and exit from your Account at the end of each session when accessing the Services on a shared device; and (d) maintain appropriate security and control of any and all devices, passwords, security codes, or other credentials that you use to access the Services.

You agree that you will not, directly or indirectly, and will not permit any third party to, engage in any of the following prohibited activities (collectively, “Prohibited Conduct”):

  • Violating any applicable local, state, national, or international laws or regulations;
  • Posting or disseminating false, misleading, or deceptive content;
  • Infringing upon or misappropriating the intellectual‑property, privacy, publicity, or other rights of any third party;
  • Transmitting or introducing any viruses, malware, malicious code, or other harmful or disruptive software or data;
  • Engaging in harassing, threatening, abusive, defamatory, obscene, hateful, or otherwise objectionable behavior;
  • Interfering with or disrupting the integrity or performance of the Services or the data contained therein;
  • Attempting to gain unauthorized access to any portion of the Services, related systems or networks, or another user’s Account.

PasturePost reserves the right to investigate, pursue, and enforce violations of these User Conduct provisions to the fullest extent permitted by applicable law, including by cooperating with and referring matters to law‑enforcement authorities.

You may deactivate your Account at any time by following the instructions available in your account settings. Deactivation is effective once processing is complete; however, certain data may be retained as required or permitted by law.

PasturePost may, in its sole discretion and with or without prior notice, suspend, restrict, or terminate your Account or your access to any or all of the Services for any reason or no reason, including, without limitation: (a) your violation of these Terms or any of our policies; (b) any illegal, fraudulent, or unauthorized use of the Services; (c) failure to pay fees or other amounts due; or (d) to comply with legal requirements, protect other users, or safeguard the security and integrity of the Services.

Upon the effective date of termination: (i) all rights and licenses granted to you under these Terms will immediately cease; (ii) PasturePost may deactivate or delete your Account and any associated User Content from our systems, except to the extent we are required or permitted to retain such data by law; (iii) any fees or other amounts accrued prior to termination will remain due and payable; and (iv) those provisions of these Terms that by their nature should survive termination will continue in full force and effect, including, without limitation, the sections concerning Intellectual‑Property Rights, Fees and Payments, User Content licenses, Disclaimers, Limitation of Liability, Indemnification, and the Dispute‑Resolution provisions, if any.

LISTINGS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

You are solely responsible for your User Content. You retain all right, title, and interest in and to any content, data, images, text, listings, messages, reviews, or other materials that you upload, post, or otherwise make available through the Services (“User Content”), subject to the license you grant below.

By submitting User Content, you grant PasturePost and its affiliates a worldwide, non‑exclusive, transferable, sublicensable, perpetual, irrevocable, royalty‑free license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, publicly perform, publicly display, distribute, and otherwise exploit such User Content, in whole or in part, in any media or distribution methods now known or later developed, for the purpose of operating, marketing, improving, and providing the Services. Where legally permissible, this license survives termination of these Terms or your Account.

You represent and warrant that: (a) you own or otherwise have all necessary rights to submit the User Content and to grant the license set forth herein; (b) your User Content is accurate, not misleading, and does not violate these Terms or any applicable law; and (c) the use of your User Content by PasturePost and its users will not infringe or misappropriate any third‑party rights or cause injury to any person or entity. You agree to indemnify, defend, and hold harmless PasturePost, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims arising out of or related to your User Content.

PasturePost has the right, but not the obligation, to pre‑screen, monitor, review, remove, refuse, or edit any User Content at any time and for any reason, in its sole discretion, without notice.

Any informational material provided through the Services—including, without limitation, blog posts, articles, tutorials, FAQs, and other resources (“Informational Content”)—is offered solely for general educational and informational purposes. PasturePost does not warrant the accuracy, completeness, timeliness, or reliability of any Informational Content and does not endorse, recommend, or guarantee any products, services, practices, or opinions referenced therein. Informational Content is not a substitute for professional, veterinary, legal, financial, or other expert advice, and nothing on the Services should be construed as such. You acknowledge and agree that reliance on any Informational Content is entirely at your own risk, and you should seek independent professional advice before acting on any information or recommendations presented through the Services.

You must provide accurate, current, and complete information for all listings, including all relevant details about the horse, item, or service being offered. Misrepresentations, omissions, or deceptive claims are strictly prohibited and may result in listing removal or account suspension. All listings must comply with (i) all applicable local, state, national, and international laws and regulations; and (ii) the then‑current PasturePost policies, rules, and guidelines. You may not list, offer, or solicit any item or service that is prohibited under these Terms or under applicable law.

Prohibited items and services include, without limitation: (a) stolen or otherwise illegally obtained goods; (b) illegal substances, materials, or contraband; (c) items or services that infringe or violate the intellectual‑property, privacy, or other rights of a third party; and (d) items or services subject to embargoes, sanctions, or other trade restrictions.

PAYMENTS, PRICING, AND PROMOTIONS

PasturePost provides an online venue through which buyers and sellers may discover, communicate, and transact with one another. All purchase, sale, and service arrangements are concluded directly between the participating users. PasturePost does not act as an agent or representative of either party and does not take possession of—or responsibility for—any item, payment, or service.

PasturePost does not endorse, warrant, or guarantee any user, listing, or User Content. Without limiting the generality of the foregoing, we make no representations regarding (a) the quality, safety, legality, or availability of any listed item or service; (b) the truthfulness or accuracy of listings or User Content; (c) a seller’s ability to deliver items or perform services; or (d) a buyer’s ability or willingness to remit payment.

All purchases and sales are undertaken at the parties’ sole risk. PasturePost disclaims any liability for loss, damage, or destruction of items at any point before, during, or after shipment, and does not insure shipments or transactions. Any disagreement, claim, or controversy arising out of or relating to a transaction is strictly between the buyer and the seller. PasturePost is under no obligation to mediate, arbitrate, or otherwise resolve such disputes, but we may, in our sole discretion, elect to offer information or limited assistance in an effort to facilitate an amicable resolution.

Certain categories of listings—or optional promotional enhancements—require payment of listing fees as described on our Pricing page or otherwise communicated to you in advance. Listing fees are charged at the time the listing is submitted and are non‑refundable except as required by applicable law. PasturePost may revise listing fees from time to time; any change will apply prospectively to listings created after we provide notice of the updated fees.

Fees for subscription offerings such as PasturePost Pro are billed in advance on an annual basis (or on another cycle that we make available and you select) and are non‑refundable, in whole or in part, except where required by applicable law. Unless you cancel before the end of the then‑current billing period, your membership will automatically renew at the then‑current rate, and you authorize us or our payment processor to charge the payment method on file.

All fees and other monetary transactions facilitated through the Services are processed by independent third‑party payment processors. By submitting a payment, you agree to comply with all applicable terms, conditions, and privacy policies of such processors. PasturePost is not a party to any agreement between you and a payment processor and disclaims liability for any act or omission of the processor.

You are solely responsible for determining, collecting, reporting, and remitting any taxes, duties, or other governmental assessments that may be due in connection with your use of the Services or any transactions you conclude through the Services. PasturePost does not provide tax advice and will not calculate, collect, report, or remit taxes on your behalf.

LICENSE AND ACCESS

Subject to your continued compliance with these Terms, PasturePost grants you a limited, non‑exclusive, non‑transferable, non‑sublicensable, and revocable license to access and use the Services and to view the PasturePost Content solely for your personal, non‑commercial use in connection with your legitimate use of the Services.

Except as expressly permitted by these Terms or as otherwise authorized in writing by PasturePost, you agree that you will not: (a) copy, reproduce, modify, adapt, translate, create derivative works from, distribute, publicly perform, publicly display, transmit, or otherwise exploit any PasturePost Content; (b) employ data‑mining, robots, spiders, or similar data‑gathering or extraction tools; (c) frame, mirror, or otherwise enclose any PasturePost trademark, logo, or other proprietary information (including images, text, page layout, or form) without our prior written consent; or (d) use any meta tags or other “hidden text” incorporating PasturePost’s name or trademarks without our prior written consent.

All rights not expressly granted to you herein are reserved and retained by PasturePost and its licensors.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The Services—including all listings, User Content, Informational Content, and other materials—are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, PasturePost expressly disclaims: (a) all implied warranties of merchantability, fitness for a particular purpose, and non‑infringement; (b) any warranties arising from course of dealing, course of performance, or usage of trade; and (c) any warranties that the Services will meet your requirements or be uninterrupted, secure, or error‑free. PasturePost does not warrant the accuracy, reliability, completeness, or timeliness of any content accessed through the Services and assumes no liability for actions taken—or not taken—in reliance on such content. You are solely responsible for verifying the applicability and relevance of any information obtained through the Services before acting upon it.

To the fullest extent permitted by law, PasturePost, its affiliates, and their respective directors, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages—or for any loss of profits, revenues, data, goodwill, or other intangible losses—arising out of or in connection with your access to or use of (or inability to access or use) the Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if PasturePost has been advised of the possibility of such damages. In no event will PasturePost’s aggregate liability to you for all claims related to the Services exceed the greater of: (i) the total amount you paid to PasturePost in the twelve (12) months immediately preceding the event giving rise to the claim; or (ii) one‑hundred U.S. dollars (USD $100).

APPLICABLE LAW

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, “Disputes”) will be governed by, and construed in accordance with, the federal laws of the United States and the laws of the State of Delaware, without regard to its conflict‑of‑law principles.

DISPUTES

You agree to indemnify, defend, and hold harmless PasturePost, its affiliates, and their respective officers, directors, employees, agents, licensors, and partners (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, suits, investigations, liabilities, damages, losses, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your access to or use of the Services; (b) any User Content you submit, post, or otherwise make available through the Services; (c) your breach or alleged breach of these Terms or any applicable law; or (d) your infringement, misappropriation, or violation of any third‑party right, including any intellectual‑property or privacy right. PasturePost reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with PasturePost in asserting any available defenses.

You and PasturePost agree that any Dispute that cannot be resolved informally shall be resolved exclusively through final and binding arbitration rather than in court, except that either party may seek relief in small‑claims court for qualifying claims.

The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect (the “AAA Rules”), as modified by these Terms. The arbitration shall be conducted in New York, New York, USA—or another location to which the parties mutually agree—by a single, neutral arbitrator. The arbitrator’s award shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction.

If you prefer not to arbitrate, you may opt out of this Arbitration Agreement by sending us a written notice that includes your name, mailing address, and a clear statement of your decision to opt out within thirty (30) days of first accepting these Terms. If we do not receive a notice postmarked within that window, you agree that all Disputes will be resolved through binding arbitration under this agreement.

If, and only if, a Dispute is found by a court of competent jurisdiction to be excluded from the scope of the Arbitration Agreement, the parties agree that such litigation shall be brought exclusively in the state or federal courts located in New Castle County, Delaware, and the parties hereby submit to the personal jurisdiction of such courts for that purpose.

YOU AND PASTUREPOST AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR OR COURT MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

PasturePost reserves the right to modify, suspend, or discontinue the Services—or any feature or functionality thereof—at any time, temporarily or permanently, with or without notice. You acknowledge that PasturePost will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
We may revise these Terms from time to time. If we make material changes, we will provide reasonable advance notice by: (a) posting the updated Terms within the Services; (b) updating the “Effective Date” at the top of the Terms; and/or (c) sending you an email or in‑product notification. Unless a shorter period is required by law, the revised Terms will become effective no earlier than fourteen (14) days after we post or otherwise notify you of the changes. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of those changes.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect. No waiver by PasturePost of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of PasturePost to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

These Terms, together with any Additional Terms and policies referenced herein (including the Privacy Policy), constitute the entire agreement between you and PasturePost with respect to the Services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written. You may not assign, delegate, or transfer these Terms or any of your rights or obligations hereunder without PasturePost’s prior written consent. PasturePost may assign or transfer these Terms, in whole or in part, without restriction and without notice to you.

    • Listings, photos, descriptions, prices, and availability you upload
    • Messages, reviews, comments, and other content you create

Automatic Information
When you interact with PasturePost, we automatically collect and store certain data, such as:

  • Device identifiers and hardware model
  • IP address and approximate location
  • Browser type, language, and settings
  • Pages or screens viewed, referring URLs, search terms, and timestamps
  • Crash reports, diagnostic logs, and other usage statistics
  • Cookies, pixel tags, and similar technologies that help us recognize your browser or device, remember preferences, and measure site performance

Information from Other Sources
We may supplement the data above with information obtained from:

  • Payment processors (e.g., payment confirmations, dispute data)
  • Marketing partners and analytics providers (e.g., ad performance metrics, demographic insights)
  • Social‑media platforms
  • Publicly available sources and data licensors

We use safeguards and contractual protections when receiving data from third parties and do not combine it with your PasturePost activity unless permitted by law or your consent.

For What Purposes Does PasturePost Use Your Personal Information?

We use your personal information to operate, provide, develop, and improve PasturePost Services. These purposes include:

Listings and transactions. We use your information to create and manage listings, facilitate inquiries, process payments, arrange delivery or pickup, verify completion, and keep you informed about listings, orders, and promotional offers.
Provide, troubleshoot, and improve PasturePost Services. We use your information to deliver core functionality, monitor performance, diagnose and fix errors, run analytics, test new features, and enhance the overall reliability, speed, and usability of the Services.
Recommendations and personalization. We use your information to suggest listings, breeders, service providers, and other features or content that align with your interests, browsing behavior, and stated preferences.
Photo, video, and messaging services. When you upload images or videos, or use in‑platform messaging, we process that data to store and display the content, provide real‑time chat, moderate for safety, and improve media quality and delivery.
Comply with legal obligations. In certain cases, we collect and use your information to verify identities, maintain records, satisfy tax or regulatory requirements, and respond to lawful requests from courts or authorities.
Communicate with you. We use your information to contact you via email, phone, push notification, or in‑app message center regarding account activity, listings, transactions, surveys, policy updates, and other important notices.
Advertising and marketing. We use your information to show you PasturePost interest‑based ads, promotions, and feature announcements. We do not use data that directly identifies you to display interest‑based ads for third parties.
Fraud prevention. We use information to detect, investigate, and prevent fraud, abuse, and security threats, enforce our Terms, and protect the safety of our marketplace and its users.

Cookies and Other Identifiers

We use first and third‑party cookies, pixel tags, local‑storage objects, software development kits (SDKs), and similar technologies to recognize your browser or device, remember your settings, understand how you interact with listings, measure campaign effectiveness, and deliver content that matches your interests. Some of these technologies are essential for security and basic site functions (such as keeping you signed in or processing payments), while others are functional or analytical and help us improve performance, personalize recommendations, and show you PasturePost promotions that are more relevant to you. You can control most cookies through your browser or device settings, and you may also opt out of certain interest‑based advertising by adjusting your privacy preferences in the app or on our website. Disabling cookies may, however, limit features like saved searches, seamless checkout, and personalized suggestions. Does PasturePost Share Your Personal Information?

We do not sell your personal information. We share personal information only as described below:

Service Providers: Third‑party companies that perform services on our behalf—such as payment processing, order fulfillment and shipping, cloud hosting, data analytics, customer support, marketing, and security—receive only the information necessary to carry out their contracted duties and are prohibited from using it for any other purpose.
Business Transfers: If PasturePost enters into a merger, acquisition, reorganization, bankruptcy, or sale of assets, personal information may be transferred as part of that transaction and will remain subject to this Privacy Notice unless you are notified otherwise.
Legal and Protection: We may disclose personal information to comply with applicable laws or valid legal processes, enforce our Terms, protect the rights, property, or safety of PasturePost, users, or others, and to detect, investigate, and prevent fraud or security issues.

We may share your information for other purposes with your explicit consent.

How Secure Is Information About Me?

We design PasturePost’s infrastructure with multiple layers of protection to keep your data safe.

Encryption in transit and at rest. We use TLS 1.3/HTTPS and industry‑standard encryption algorithms (such as AES‑256) to safeguard personal information while it moves across networks and while it is stored on our servers and backup media.
Administrative, technical, and physical safeguards. We maintain firewalls, DDoS mitigation, role‑based access controls, routine penetration testing, vulnerability scanning, security awareness training, and secure facilities. Access to personal data is limited to authorized personnel bound by confidentiality obligations.
